KMKSC advises all companies to have a plan for continuing the business in the event of a devastating accident or act of God. A key element of this is the protection of critical documents, and today this inevitably includes computer files and data. Though businesses may have some form of continuity planning, it may be inadequate for their needs. KMKSC can conduct a continuity review. Our major interest is to lessen the heavy burdens placed upon companies, in-house counsel and executives regarding the protection of information pertinent to anticipated litigation.
The consequences of non-compliance can be severe and include large cash sanctions, dismissal, or a summary ruling in favor of the other party without a trial on the merits of the case. Officers, owners and executives may have affirmative duties when placed on notice of litigation. KMKSC has developed expertise in the area of what may trigger those duties and the creation of the legal and human processes required to protect clients. In doing so, we consider existing continuity capabilities and seek to minimize cost and duplication by incorporating these wherever possible.
Though we do not advise on software and hardware to achieve electronic compliance, we do stipulate the required capabilities, and propose a number of alternative providers that we believe have the experience and industry knowledge to satisfy clients’ particular needs.
